How long does it take to get my trademark registered?

The current timeline is 12 to 16 months to the examination report, and 18 to 24 months to the registration certificate (®). Once registered, it is valid for 10 years and renewable. You can start using the ™ symbol immediately after filing — you do not have to wait for registration.

Can I expedite my trademark application?

Yes. Expedited examination is a separate process from filing. It moves your application to the front of the examination queue, so the government typically issues the examination report within 5 to 25 days instead of 12 to 16 months, provided no objection is raised. It costs ₹25,500 per class: ₹20,000 government fee, ₹1,500 for notary, applicant affidavit and stamp duty, and ₹4,000 Bentham professional fee. We prepare and file the expedited request for you.

Who reviews my application before filing?

I have received a conflict in my application. Can you help?

Yes. A conflict in your examination report means the examiner has cited one or more earlier marks considered similar to yours, or raised an objection on absolute grounds such as the mark being descriptive. It is not a refusal, and it is a stage many applications go through — you have a right of reply within the deadline stated in the report. The usual routes are a written reply arguing distinctiveness or prior use with supporting evidence, a consent or coexistence letter from the proprietor of the cited mark, narrowing your goods and services so the overlap disappears, or a hearing if the written reply alone does not clear it. Which route applies depends on what was cited and how long you have been using the mark. Our trademark attorneys handle the response end to end.
